Justice Ginnane said the prison allowed for inmates to exercise their religions including Islam, Buddhism, Judaism and Christianity - and that Paganism was also included. In late , Haigh applied to the jail for three packs of tarot cards, which he argued was important in the practise of his religion. Prison governor Brett Ryan refused the request in January , stating Haigh's use of tarot cards could undermine the prison's security, potentially by causing unrest or manipulating vulnerable prisoners.
The prisons operations manager complained about four of the cards featuring female characters with bare breasts.
Haigh argued without the cards, the tarot deck couldn't be used, and their removal was "an unlawful limitation on his right to freedom of thought, conscience, religion and belief". But Justice Ginnane said it was not the role of the "judicial function" to stipulate how people practise religion. The judge said that, on the assumed belief Paganism is a religion, the withholding of the four tarot cards which Haigh wished to use, "does engage his right of religious freedom and belief.
So, too, is her affinity for the Tarot's Fool card, a "trickster" who brings "adventure, misadventure, but rarely happiness. Yes, salver.
